Have a divorce or real estate-related question? We have the answer. Check out these FAQs and give us a call today for more information!

  • What is divorce mediation?

Divorce mediation is a voluntary process where a neutral attorney (the mediator) helps couples reach agreements on issues like property division, child custody, and support — without going to court.

  • How does the process work?

Both parties meet with Attorney Brakeman to discuss and resolve issues. We facilitate communication, identify options, and guide toward a mutually acceptable agreement.

  • Is mediation legally binding?

Yes. Once both parties agree and the agreement is reviewed and approved by the court, it becomes a legally binding divorce judgment.

  • How long does mediation take?

Mediation is significantly quicker than the litigation process; however, the length of the process depends on each case.

  • Is mediation cheaper than going to court?

Yes. Mediation is generally far less expensive than a litigated divorce.

  • What issues are covered in mediation?

    • Parenting plans and custody
    • Division of assets and debts
    • Spousal and child support
    • Health insurance and college expenses
    • Tax considerations
  • Is mediation confidential?

Yes. Unlike court proceedings, mediation is a private and confidential process.

  • What are the benefits of mediation?

    • Faster resolution
    • Lower cost
    • Less emotional stress
    • More control over outcomes
    • Better post-divorce communication, especially for co-parenting
